Working legally on construction sites in Luxembourg: what you need to know!

Luxembourg’s construction market offers excellent opportunities, but it demands impeccable compliance. The Inspectorate of Labour and Mines (ITM) carries out extremely rigorous on-site inspections. A simple administrative oversight can lead to an immediate shutdown of your site and fines ranging from €1,000 to €5,000 for each non-compliant employee.

To work safely on a Luxembourg construction site, whether as a main contractor or a posted subcontractor, these mandatory procedures need to be completed before putting on your hard hat:

1. The posting declaration and the Social Badge (ITM)

Every employee posted to Luxembourg must be declared to the ITM in advance.

The Social Badge is mandatory: each worker must carry their individual identifier generated by the ITM from the moment they arrive on site.

2. A1 certificates and employment legislation

A valid A1 form is mandatory for everyone involved to prove their social security affiliation.

Luxembourg’s minimum pay scales must be strictly observed (the minimum social wage for skilled or unskilled workers, as applicable in the construction sector).

3. Third-country nationals (outside the EU, e.g. Ukraine)

Subcontracting rules for non-EU personnel are stricter: you must ensure that they hold valid residence documents, appropriate visas and work permits applicable to cross-border posting.

4. Business permits and VAT registration

To operate directly in Luxembourg, a business permit issued by the Ministry of the Economy and registration with the AED for VAT are essential to avoid tax-related obstacles.
